PAPERLESS ORDER GRANTING 10 the Plaintiffs Motion for Leave to Conduct Expedited Third-Party Discovery (the "Motion"). After review of the Motion, the record, and the applicable law, we find good cause to allow the Plaintiff to serve a third-party subpoena on the e-commerce platforms and payment processors utilized by the Defendants in connection with any of their online stores (collectively the "Third-Party Providers"). The Plaintiff may serve the Third-Party Providers with a Rule 45 subpoena commanding them to provide the Plaintiff with copies of all documents and records in such party's possession or control regarding: i) all information, financial accounts or sub-accounts, associated with the Defendants; ii) all other accounts which transfer funds into the same financial institution account(s) or any of the other financial accounts subject to the TRO entered in this action; iii) an accounting of all funds restrained and identify the financial account(s) and sub-account(s) which the restrained funds are related to; iv) the account transactions related to all funds transmitted into the financial account(s) and sub-account(s) which have been restrained; v) the true identities including names, addresses, email addresses, and IP addresses, of each person who registered, is listed in, logged into, used, or who otherwise handled or is associated with the financial/payment processing accounts of any of the Defendants; vi) the full list of stores and associated financial/payment processing account(s); vii) the full list of stores and associated financial/payment processing account(s) opened, operated by, or at any time used by the Defendants. The Plaintiff is also authorized to issue expedited discovery requests, pursuant to Fed. R. Civ. PAPERLESS ORDER GRANTING IN PART 17 the Plaintiff's Ex Parte Application to Extend the Temporary Restraining Order Entered July 10, 2023 (the "Motion"). In the Motion, the Plaintiff says that it "has not yet been able to complete service [of process] on [the] Defendants" because it has been unable to "confirm implementation of the sealed TRO." "Courts have the inherent authority to control the proceedings before them, which includes the authority to impose reasonable and appropriate sanctions." Martin v. Automobili Lamborghini Exclusive, Inc., 307 F.3d 1332, 1335 (11th Cir. 2002). This includes the power to allow a plaintiff to seek default judgment "when a party willfully fails to comply with a court order after the court has given the party ample opportunity and time to comply." Great Lakes Reins. (UK) PLC v. Miami Michaim Yacht Rentals, 2009 WL 10699628, at *1 (S.D. Fla. Apr. 14, 2009) (Cooke, J.) (citing Compania Interamericana Exp.-Imp., S.A. v. Compania Dominicana De Aviacion, 88 F.3d 948 (11th Cir. 1996)). Here, the Palmer Defendants haven't filed the required disclosures, even after we sua sponte extended their deadline to do so. See Paperless Order Extending Deadline. We'll now exercise our "authority to enforce [our] orders and [e]nsure prompt disposition of [this] lawsuit[.]" Goforth v. Owens, 766 F.2d 1533, 1535 (11th Cir. 1985). Accordingly, the Plaintiff is ORDERED to move for Clerk's Entry of Default against the Palmer Defendants by May 20, 2024. PAPERLESS ORDER. The parties have filed a [161] Notice of Mediator Selection (the "Notice"). Although the Notice states that the parties have selected a mediator, see id. at 1, it fails to report the "time, date, and place for mediation," as is required under [144] our Scheduling Order. The parties inform us that they "require additional time to confer on a mutually agreeable date and time for the mediation, which will be provided in a forthcoming proposed order submitted to the Court." Notice at 1. That's not good enough. Our Scheduling Order, which required the parties to file their fully compliant proposed order scheduling mediation by June 10, 2024, see Scheduling Order at 1, isn't some "frivolous piece of paper idly entered, which can be cavalierly disregarded without peril." Asokan v. Am. Gen. Life Ins. Co., 302 F. Supp. 3d 1303, 1312 (M.D. Fla. 2017) (Byron, J.) (quoting O'Connell v. Hyatt Hotels of P.R., 357 F.3d 152, 155 (1st Cir. 2004)). PAPERLESS ORDER. On August 15, 2024, the parties informed us that mediation in this case would be held on August 20, 2024. See 172 Notice of Mediation at 1. We then ordered the parties to file their joint mediation report "[w]ithin three days of the mediation," giving them until August 23, 2024, to do so. 173 Amnd. Order Scheduling Mediation at 1. And we warned the parties that their failure to comply with that order "may result in sanctions, including dismissal without prejudice and without further notice." Ibid. (emphasis added). That day has since passed, and the parties haven't filed anything. See generally Docket. "Courts have the inherent authority to control the proceedings before them, which includes the authority to impose reasonable and appropriate sanctions." Martin v. Automobili Lamborghini Exclusive, Inc., 307 F.3d 1332, 1335 (11th Cir. 2002). Rule 41 of the Federal Rules of Civil Procedure also grants courts the authority to dismiss an action because of a party's failure to comply with court orders. See Fed. R. Civ. P. 41(b) ("If the plaintiff fails to prosecute or to comply with these rules or a court order, a defendant may move to dismiss the action or any claim against it."); see also Goforth v. Owens, 766 F.2d 1533, 1535 (11th Cir. 1985) ("The court's power to dismiss is an inherent aspect of its authority to enforce its orders and insure prompt disposition of lawsuits."). This isn't the first time the parties have missed a mediation deadline. See Paperless Order [ECF No. 163] ("Our Scheduling Order, which required the parties to file their fully compliant proposed order scheduling mediation by June 10, 2024. isn't some 'frivolous piece of paper idly entered, which can be cavalierly disregarded without peril.'" (quoting Asokan v. Am. Gen. Life Ins. Co., 302 F. Supp. 3d 1303, 1312 (M.D. Fla. 2017) (Byron, J.))). But it will be the last. Because the parties have failed to follow our orders—despite our clear warning that their case would be dismissed in the event of noncompliance—we'll now exercise our "authority to enforce [our] orders and [e]nsure prompt disposition of lawsuits." Goforth, 766 F.2d at 1535. Accordingly, we hereby ORDER and ADJUDGE that this case is DISMISSED without prejudice. The Clerk shall CLOSE this case.
