Parties and counsel must abide by the following: Counsel must meet (in person, on the phone, via videoconference, or on some other similar platform) with their clients before the hearing to discuss measures that will ensure that both counsel and client have the ability to participate in a Zoom videoconference, with a stable internet connection. In particular, clients unfamiliar with Zoom should do an advance practice run at the location where they will participate in the hearing. If a client plans to be at home, and if there will be multiple users of Wi-Fi during the hearing, then the demand on Wi-Fi may cause the client's internet connection to be unstable. Good troubleshooting tips include rebooting the Wi-Fi router before the Zoom session, locating the device near the router during the Zoom session, and minimizing the interference of other devices on the Wi-Fi bandwidth. If there is any doubt about a client's ability to maintain a stable connection to Zoom during their participation in the hearing, then counsel shall make arrangements for the client to participate at counsel's office. PAPERLESS ORDER RE: 14 Plaintiff's Motion for Default Judgment. Plaintiff's Complaint states that "Defendants are manufacturing, distributing, offering for sale, selling, and/or importing into the United States, products which infringe directly or indirectly on at least one or more of the Utility Patents both literally and under the doctrine of equivalents." [ECF No. 1, p. 54]. In its Motion, Plaintiff recognizes that it "must establish that 'every limitation set forth in a claim [is] found in an accused product." Becton, Dickinson & Co. v. Tyco Healthcare Group, LP, 616 F.3d 1249, 1253 (Fed. Cir. 2010) (quoting Southwall Techs., Inc. v. Cardinal IG Co., 54 F.3d 1570, 1575 (Fed. Cir. 1995))". [ECF No. 14, p. 9]. Additionally, "infringement under the doctrine of equivalents occurs when a claimed limitation and the accused product perform substantially the same function in substantially the same way to obtain substantially the same result." Bus. Objects, S.A. v. Microstrategy, Inc., 393 F.3d 1366, 1374 (Fed. Cir. 2005). However, the only time Plaintiff makes reference to a claim in its Motion is : "Defaulting Defendants' infringing products take all the integers and features of claim 1 of the patents, as well as infringe on the independent claims of the patent." Id. at 9. But, the four utility patents, while similar, do not share the same "claim 1" language. Therefore, Plaintiff has until April 11, 2024 to file either supplemental memoranda addressing this issue or a notice withdrawing its claim as to Count 1. In the supplemental memoranda, Plaintiff would need to address which specific claim limitations are found in which of Defaulting Defendants' products and whether (including how) those alleged infringed products "perform substantially the same function in substantially the same way to obtain substantially the same result." PAPERLESS ORDER TO SHOW CAUSE: On May 14, 2024, the Court granted the Plaintiff's motion for final default judgment against the Defaulting Defendants on Plaintiff's design patent infringement claim. Prior to the entry of final default judgment, the Plaintiff withdrew its claim for entry of final default judgment against the Defaulting Defendants for utility patent infringement. However, the Plaintiff has not yet dismissed the claim outright. The Court's prior order required the Plaintiff to either move for default judgment or file a notice of joint liability by February 15, 2024. (ECF No. 83.) Accordingly, the Court directs the Plaintiff, by June 5, 2024, to either move for final default judgment on the utility patent claim, dismiss the utility patent claim, or show cause as to why the utility patent claim should not be dismissed.
