MINUTE entry before the Honorable John Robert Blakey: Plaintiff has sued sixty-five sellers alleging patent infringement, see [1], [2], and seeks a temporary restraining order to enjoin, inter alia, any further sales of unauthorized products. 35 U.S.C. § 299 provides that "accused infringers may be joined in one action as defendants. only if-- (1) any right to relief is asserted against the parties jointly, severally, or in the alternative with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences relating to the making, using, importing into the United States, offering for sale, or selling of the same accused product or process; and (2) questions of fact common to all defendants or counterclaim defendants will arise in the action. Id. § 299(a). The statute specifically provides that "accused infringers may not be joined in one action as defendants. based solely on allegations that they each have infringed the patent or patents in suit." Id. § 299(b). Here, Plaintiff's allegations support the joinder of Defendants in this single action. Plaintiff has alleged and established, via declaration, that "the e-commerce stores operating under the Seller Aliases often share unique identifiers, such as templates with common design elements that intentionally omit any contact information or other information for identifying Defendants or other Seller Aliases they operate or use." [1] 18. Plaintiff has also alleged and established that the e-commerce stores operating under the Seller Aliases "include other notable common features, such as use of the same registration patterns, accepted payment methods, check-out methods, keywords, advertising tactics, similarities in price and quantities, the same incorrect grammar and misspellings, and/or the use of the same text and images," and that the products sold by the Seller Aliases "bear similar irregularities and indicia of being unauthorized to one another, suggesting that the Infringing Products were manufactured by and come from a common source and that Defendants are interrelated." Id. See also [16] 14. For present purposes, this satisfies the "series of transactions or occurrences" requirement of section 299(a)(1), as well as Fed. R. Civ. P. 20(a)(2). Additionally, based upon the materials submitted, this Court grants Plaintiff's motion for leave to file under seal [4] and motion for electronic service of process [18]. The Court also grants Plaintiff's ex parte motion for entry of a temporary restraining order [13]. Enter sealed temporary restraining order. Absent further order, this TRO will expire on 12/2/22. MINUTE entry before the Honorable John Robert Blakey: In light of this Court's order extending the deadline for Defendant to answer or otherwise plead, the Court denies without prejudice Plaintiff's motion for default and default judgment [55] and strikes the 3/2/23 motion hearing date. Additionally, the Court grants Plaintiff's motion to strike certain affirmative defenses asserted by Defendants SINOAY and YAMYONE [44]. These Defendants assert seven affirmative defenses: (1) failure to state a claim; (2) extraterritoriality; (3) first sale doctrine; (4) limitation on costs and damages; (5) laches, estoppel, acquiescence, waiver, and unclean hands; (6) functionality; and (7) invalidity. See [36] at 4-5; [37] at 4-5. They also assert a general reservation of rights as to additional defenses. Affirmative defenses must satisfy federal pleading requirements, meaning they must set forth a "short and plain statement" of the material elements of the defense and contain sufficient factual material thattaken as truestates a facially plausible defense. See Achi v. TIA Transp., Inc., No. 16-cv-11632, 2017 WL 5890875, at *1 (N.D. Ill. Nov. 29, 2017); see also Ashcroft v. Iqbal, 556 U.S. 662, 678 (2009). A motion to strike an affirmative defense should succeed only when "it appears to a certainty" that the plaintiff would win "despite any state of the facts which could be proved in support of the defense." Williams v. Jader Fuel Co., 944 F.2d 1388, 1400 (7th Cir. 1991). Defendants' defenses fail to set forth any facts and thus fail to satisfy federal pleading standards. Indeed, Defendants do not attempt to defend their pleadings, instead consenting to the motion and agreeing that the defenses should be stricken. See [59]. Accordingly, the Court grants Plaintiff's motion to strike [44] and strikes Defendants SINOAY's and YAMYONE's second, third, fourth, fifth, sixth, and seventh affirmative defenses. The Court also strikes Defendants' reservations of rights. E.g., Aylin & Ramtin, LLC v. Barnhardt, No. 19-CV-3402, 2022 WL 658786, at *4 (N.D. Ill. Mar. 4, 2022)("A reservation of rights is not an affirmative defense. It is unnecessary, too, because 'there is no procedure for reserving a right to plead affirmative defenses at a later date.'").
