Bestway raises no new facts or arguments the Court failed to consider in granting the motion for bond damages. The Court notes that it did not order bond damages because Bestway failed to lift the hold on Defendants' Amazon accounts, because of course Bestway does not have the ability to do that. The Court ordered bond damages because Bestway refused to assist Defendants in communicating with Amazon when Amazon had failed to comply with lifting the hold. In the order, the Court noted that in response to Defendants' seeking assistance, Bestway responded, "We do not consent to the ASIN's being reinstated because it would allow your client to continue to use our client's trademarked name in their product listing and would effectively provide them with a no-cost license to use our client's trademark." There was no basis for Bestway to take this position, as is demonstrated by the fact that Bestway eventually acquiesced to Defendants' request and again contacted Amazon in September 2023. Additionally, Bestway's motion to implead Amazon is denied. Bestway's purported claim against Amazon is not related to the substance of its claims against Defendants. Bestway can file a separate lawsuit against Amazon if it believes it has a plausible claim. Mailed notice.
