MINUTE entry before the Honorable John J. Tharp, Jr: The plaintiff's motion for leave to file under seal 6 is granted. The plaintiff's motion for entry of TRO 9 is denied without prejudice. The complaint contains the same defect this Court has identified in three of the plaintiff's previous, voluntarily dismissed cases (22-cv-00534, 22-cv-00972, and 22-cv-01695). In each of those cases, plaintiff's counsel indicated upon questioning that the allegation of false designation of origin was inadvertently included in the complaint. Such allegation is again included here and again calls into question the propriety of a temporary restraining order. An ex parte telephone conference will be held at 9:15 a.m. on Tuesday, May 2, 2023. For instructions regarding participation in, or access to, the telephone hearing, see the standing order on telephone hearings on Judge Tharp's web page (https://www.ilnd.uscourts.gov/judge-info.aspx?79eF+7uiX7ewBj/ITKrjoA==). MINUTE entry before the Honorable John J. Tharp, Jr:Telephone conference held. Plaintiff's oral motion for leave to file an amended complaint striking the trademark claim is granted; amended complaint due by 5/16/23. Motion for temporary restraining order 9 is denied without prejudice to the filing of a renewed motion that reflects that the amended complaint asserts only a copyright claim. Mailed notice |

MINUTE entry before the Honorable John J. Tharp, Jr:The plaintiff's ex parte motion for TRO 21 is denied without prejudice. The plaintiff's Exhibit 2 to the Declaration 23 - 29 does not identify where the evidence of one defendant online marketplace's infringement ends and evidence of another defendant's alleged infringements begins. Further, upon examination of some of the screenshots included in that exhibit, it is not clear which registered copyright is being infringed in numerous screenshots. As one of numerous examples, the screenshot on page 16 of 258 of ECF No. 24 does not appear to infringe on any of the registered copyrights included in Exhibit 1 to the Complaint. This suggests a need for the plaintiff to reevaluate its format for presenting the alleged infringements to the Court in Exhibit 2 to the Declaration, and whether it has included unmeritorious allegations of infringements by products or marketplaces more generally. The plaintiff is granted leave to refile, as necessary, an amended complaint, schedule A, and/or renewed TRO with accompanying exhibits, which denotes which copyright each screenshot corresponds to, and which defendant is alleged to be responsible for infringing the identified copyright, by 6/29/23. MINUTE entry before the Honorable John J. Tharp, Jr:On the grounds set forth in the motion, plaintiff's motion for entry of a preliminary injunction 50 is granted. Enter preliminary injunction order. The preliminary injunction directs, among other things, that Amended Schedule A be unsealed. Plaintiff is ordered to enter in CM/ECF no later than 8/3/23 each defendant named in the original Schedule A as a party in this case (where a defendant has been dismissed, the CM/ECF entry should reflect that status). Failure to timely comply with this requirement may result in vacating the preliminary injunction.
