MINUTE entry before the Honorable Jeffrey I Cummings: The Court has reviewed plaintiff's motion to stay defendant's motions and for leave to conduct discovery 48, defendant Lukanoryz's response 53, and plaintiff's reply 54. Plaintiff's motion to stay and to conduct limited discovery 48 is granted. Notwithstanding the issue of whether defendant Lukanoryz is in fact a sole proprietorship that could proceed pro se, at a minimum as plaintiff argues defendant's filings raise questions as to the relationship between defendant Lukanoryz and the individual filing motions on its behalf, Xianyang Zeng. Thus, the parties shall proceed with limited discovery targeting: (1) whether defendant Lukanoryz is a sole proprietorship; (2) the relationship between Lukanoryz and Xianyang Zeng; and (3)the additional issues raised in defendant's declarations in support of its multiple motions to vacate judgment and dismiss. By 5/24/24, the parties shall meet and confer and file a joint status report providing a schedule for the completion of that discovery. The parties are also encouraged to re-visit their prior settlement negotiations and shall promptly notify the Court if they reach an agreement to resolve this matter. In light of this order, and for docket management purposes, defendant Lukanoryz's motion to vacate default judgment 38, motion to substitute 39, motion to strike 40, motion to compel service of sealed documents 41, and motion to dismiss 47 are terminated without prejudice with leave to re-file as appropriate following the completion of the discovery permitted by this order. Second, plaintiffs' motion to order defendant to appear by counsel and for a referral to the Magistrate Judge for discovery supervision 71 is granted in part and denied without prejudice in part. This matter is referred to the assigned Magistrate Judge for supervision of the discovery permitted by the Court 68, including resolution of plaintiffs' motion to compel 77, the authority to set, adjust, and extend all discovery deadlines, and to conduct a settlement conference, if requested by the parties. MINUTE entry before the Honorable Jeffrey I Cummings: The Court has reviewed Magistrate Judge Valdez's 5/15/25 order 118, in which she ordered defendant Lukanoryz to pay sanctions in the amount of $875.00 to plaintiff within two weeks of the date of the order and recommended that this Court bar "Defendant from asserting any facts not included in his May 9, 2025, responses to Plaintiff's discovery requests." As of the date of this order, defendant has not filed any objections to either aspect of Magistrate Judge Valdez's order. Accordingly, the Court adopts Magistrate Judge Valdez's order in full. Schur v. L.A. Weight Loss Centers, Inc., 577 F.3d 752, 760 (7th Cir. 2009) ("If no party objects to the magistrate judge's action, the district judge may simply accept it."). To the extent it still has not done so, defendant shall pay plaintiff the $875 sanction on or before 8/22/25. Moreover, despite failing to fully participate in the limited discovery period, or to pay the Court ordered sanction, defendant has filed a motion to dismiss for want of prosecution 121. That motion 121 is denied as is the motion to set a briefing schedule 122. As the docket reflects, default judgment was entered against defendant on 6/29/23, after which defendant filed a motion to vacate (among other motions), which unfortunately clouded a number of issues, including whether defendant was a corporate entity unable to proceed pro se in this matter. At plaintiff's request, the Court stayed briefing on the motions, and the Court permitted limited discovery under the supervision of Magistrate Judge Valdez, which now appears complete. By 8/22/25, defendant shall file a renewed motion to vacate the default judgment, that includes its position as to whether it can proceed pro se in this matter. Defendant is advised, however, that pursuant to Judge Valdez's order (adopted by this Court), defendant is barred from asserting any facts not included in the May 9, 2025 responses to plaintiff's discovery requests. Plaintiff shall respond to the motion to vacate by 9/5/25 and defendant shall reply by 9/19/25. The Court will review the parties' submissions and will either issue a ruling by mail, or set a hearing, if appropriate.
