This is a lawsuit in which the plaintiff has named numerous defendants claiming, among other things, infringement of a design patent. A federal statute, 35 USC 299, limits the circumstances under which a patent holder may sue multiple defendants in a single lawsuit for patent infringement. Plaintiff has not addressed section 299 in its motion for temporary restraining order or supporting memorandum. Plaintiff is directed to file by 6/22/2023 a supplement to the motion for temporary restraining order explaining the basis upon which it may appropriately join multiple defendants on the patent infringement claims (which form part of the basis for the motion for a TRO).
