In her motion, Plaintiff requests $100,000 in statutory damages per defaulting defendant. But Plaintiff fails to provide information describing "the circumstances of the infringement" by defaulting defendants, such as the duration of their infringing activity or their total or estimated sales volume, or information about the value of her copyright, to support an award of that amount. See Chi-Boy Music v. Charlie Club, Inc., 930 F.2d 1224, 1229 (7th Cir. 1991). Based on the information available on the record, the Court reduces the statutory damages to $5,000 per defaulting defendant. Plaintiff is directed to submit a proposed order consistent with this Order. Plaintiff is granted leave to file a renewed motion for default judgment by 6/16/2025 if she reasonably believes she can correct the deficiencies identified in this Order. Mailed notice. |
