Feb. 11, 2025

PRELIMINARY INJUNCTION ORDER. Signed by the Honorable Jeremy C. Daniel on 2/11/2025. The Court modified the proposed preliminary injunction as follows: (1) with respect to expedited third-party discovery, replaced "all documents" with "documents sufficient to show" as there is no reason to require expansive discovery on non-parties where the purpose of the third-party discovery is to identify the defendant, the defendant's sales, and the defendant's accounts; and (2) limited the asset restraint to money or assets "traceable to sales of the accused products" because the justification for the asset restraint stems from the plaintiff seeking equitable monetary relief, which is necessarily tied to sales of the accused products. Statutory damages, which the plaintiff may opt eventually opt for, do not support an asset restraint. The plaintiff is hereby ordered to add ALL defendant names listed in the Schedule A to the docket within three business days, instructions can be found on court's website located at www.ilnd.uscourts.gov/instructions. Mailed notice.
