Motion for preliminary injunction or motion to extend TRO must be filed by 2/19/2025. Any motion or preliminary injunction filed in this case must be accompanied by a certificate stating upon whom and how the motion has been served. Feb. 20, 2025 |
MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for entry of a preliminary injunction 27 is denied without prejudice, due to an insufficient interval between electronic service of summons (on 2/19/2025, largely to overseas entities) and the preliminary injunction hearing (the morning of 2/24/2025). The Court is no longer going to take it upon itself in these situations to extend the ex parte TRO; it is up to plaintiff's counsel to file an appropriate motion. In retrospect, maybe counsel should have done that in the first instance rather than filing the motion for preliminary injunction. |

Feb. 21, 2025 |
MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion to extend the temporary restraining order and reset the preliminary injunction hearing 31 is granted. The ex parte TRO entered by the Court on 2/10/2025 is extended through 3/10/2025. The telephonic preliminary injunction hearing set for 2/24/2025 is vacated and reset to 3/10/2025 at 9:05 AM. The following call-in number will be used for the hearing: 650-479-3207; access code 2305-915-8729. Motion for preliminary injunction must be filed by 3/6/2025. Any motion for preliminary injunction filed in this case must be accompanied by a certificate stating upon whom and how the motion has been served. In addition the Court repeats that it may deny entry of a preliminary injunction based on inadequate notice of the lawsuit if summons is not served sufficiently in advance of the preliminary injunction hearing date. |

40 |
March 17, 2025 |
MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for entry of default judgment 37 is granted. The Court has reduced the amount of the requested statutory damages award. Plaintiff has not attempted to quantify the infringing sales either overall or on a defendant-by-defendant basis though it is likely the defendant could do so (or at least attempt to do so) by obtaining records from the relevant platform(s). The reduced amount is sufficient given the nature and character of the infringement and also provides a sufficient deterrent in the Court's view. Civil case terminated. Mailed notice. |
