NOTICE of Motion by Michael A. Hierl for presentment of motion for temporary restraining order, 22, motion for leave to file excess pages 21 before Honorable Sharon Johnson Coleman on 4/8/2025 at 10:00 AM.

26

April 1, 2025

MINUTE entry before the Honorable Sharon Johnson Coleman: Status hearing held on 4/1/2025. Counsel for plaintiff reported that a motion for entry of a temporary restraining order was filed this morning but is noticed up for presentment on 4/8/2025. Counsel also reported that it brought down the number of defendants from 85 to 14. The amended complaint does not address the joinder issues noted by the Court at the hearing. Counsel is directed to review the Court's standing order on joinder in Schedule A Counterfeit cases and file a supplemental memorandum addressing the propriety of joinder of the 14 defendants in this lawsuit, at least three business days before the 4/8/2025 hearing. The Court enters and continues Plaintiff's motion to exceed page limitation 21 and ex parte motion for entry of a temporary restraining order 22 to the presentment date 4/8/2025 at 10:00 AM and will proceed as an in-person hearing. Mailed notice.

28

April 8, 2025

MINUTE entry before the Honorable Sharon Johnson Coleman: Motion hearing held on 4/8/2025. Plaintiff appeared before the Court on its motion for leave to file excess page limitation 21 and ex parte motion for entry of a temporary restraining order, including a temporary injunction, a temporary asset restraint, expedited discovery, and service of process by email and/or electronic publication 22. During the hearing, Plaintiff represented that joinder of 14 defendants was proper under United States v. Mississippi, 380 U.S. 128 (1965). United States v. Mississippi concerns voter suppression and the Court finds it inapplicable to the dispute in the pending litigation. Accordingly, the Court directs Plaintiff to file a supplemental memorandum explaining propriety of joinder pursuant to Estee Lauder Cosmetics Ltd. v. Schedule A, Case No. 19-cv-7878, 2020 WL 433870 (N.D. Ill. Jan. 27, 2020) (Chang, J.). The supplemental memorandum should also address Plaintiff's likelihood of success on the merits as to these defendants under 15 U.S.C. § 1116(a). If Plaintiff believes that it should file an amended Schedule A to address the joinder issue, Plaintiff is directed to do so. Mailed notice.
