Plaintiff appeared before the Court on its motion for leave to file excess page limitation 21 and ex parte motion for entry of a temporary restraining order, including a temporary injunction, a temporary asset restraint, expedited discovery, and service of process by email and/or electronic publication 22. During the hearing, Plaintiff represented that joinder of 14 defendants was proper under United States v. Mississippi, 380 U.S. 128 (1965). United States v. Mississippi concerns voter suppression and the Court finds it inapplicable to the dispute in the pending litigation. Accordingly, the Court directs Plaintiff to file a supplemental memorandum explaining propriety of joinder pursuant to Estee Lauder Cosmetics Ltd. v. Schedule A, Case No. 19-cv-7878, 2020 WL 433870 (N.D. Ill. Jan. 27, 2020) (Chang, J.). The supplemental memorandum should also address Plaintiff's likelihood of success on the merits as to these defendants under 15 U.S.C. § 1116(a). If Plaintiff believes that it should file an amended Schedule A to address the joinder issue, Plaintiff is directed to do so. Mailed notice. |
