MINUTE entry before the Honorable Lindsay C. Jenkins: The Court will not allow this case to proceed pseudonymously. No-name litigation is disfavored in general, and the Seventh Circuit has repeatedly voiced disfavor of parties proceeding anonymously, as anonymous litigation runs contrary to the rights of the public to have open judicial proceedings. The Court is not convinced that the circumstances described in Plaintiff's filing are exceptional; hundreds of other "Schedule A" cases proceed without anonymity and the Court cannot see why this case is any different. Upon review of the complaint, the Court sua sponte raises the propriety under Federal Rule of Civil Procedure 20(a)(2) of joining 222 defendants to this action, and dismisses the complaint. See, e.g, Estee Lauder Cosmetics Ltd. v. Partnerships & Unincorporated Associations Identified on Schedule A, 334 F.R.D. 182 (N.D. Ill. 2020). Plaintiff may file an amended complaint that supports the joinder of multiple defendants and it must ensure that its submissions demonstrate a likelihood of success as to each Defendant on the asserted claims. Plaintiff should also ensure that its submissions support the exercise of personal jurisdiction as to each defendant; in this regard, the mere maintenance of a website, even a fully interactive website accessible in Illinois, remains insufficient. E.g., Advanced Tactical Ordnance Sys., LLC v. Real Action Paintball, Inc., 751 F.3d 796, 803 (7th Cir. 2014) ("Having an interactive website. should not open a defendant up to personal jurisdiction in every spot on the planet where that interactive website is accessible."); Rubik's Brand, Ltd. v. Partnerships & Unincorporated Associations Identified on Schedule A, No. 20-CV-5338, 2021 WL 825668, at *3 (N.D. Ill. Mar. 4, 2021) (screenshot evidence showing that an order could be placed by an Illinoisan, "amounts to nothing more than maintaining an interactive website that is accessible in Illinois," and "that alone cannot confer personal jurisdiction."). An amended complaint (in Plaintiff's name) with joinder principles in mind must be filed by March 25, 2025. Failure to do so by this deadline will result in dismissal without prejudice. MINUTE entry before the Honorable Lindsay C. Jenkins: As between Plaintiff and Defendant land scape, the court declines to deny the motion for a preliminary injunction as a sanction. When Plaintiff filed a lawsuit in March 2025, it was assigned Case No. 25-cv-2707, and the judge assigned to that case ordered that the case could only proceed against a smaller subset of defendants. Plaintiff amended that complaint, and also filed a new action against the previously dismissed defendants in this case. This posture was disclosed to this court in the filing at docket entry 12-1. It was not improper for Plaintiff to proceed against dismissed defendants in a new case considering that the judge in Case No. 25-cv-2707 concluded that the defendants had been misjoined in the first place. The court does not view this as forum shopping. As to the merits, Plaintiff alleges that Defendant land scape has infringed Plaintiff's Copyright U.S. Reg. No. TX 9-456-834, which protects the design and the text of the "Tale's Life Story Interview Kit (Questions)." In deciding a motion for a preliminary injunction in a patent case, district courts apply Federal Circuit law instead of the law of the circuit in which they sit because the motion "involves substantive matters unique to patent law." Revision Mil., Inc. v. Balboa Mfg. Co., 700 F.3d 524, 525 (Fed. Cir. 2012). "To obtain a preliminary injunction, a party must show that it is likely to succeed on the merits, that it is likely to suffer irreparable harm in the absence of preliminary relief, that the balance of equities tips in its favor, and that an injunction is in the public interest." Luminara Worldwide, LLC v. Liown Elecs. Co., 814 F.3d 1343, 1352 (Fed. Cir. 2016) (quoting Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008)). "The first two factorslikelihood of success on the merits and irreparable harmare the most critical in a patent case, and a court may deny a motion for a preliminary injunction if 'a party fails to establish either of the[se] two critical factors.'" Pressure Specialist, Inc. v. Next Gen Mfg. Inc., 469 F. Supp. 3d 863, 868 (N.D. Ill. 2020) (quoting Reebok Int'l Ltd. v. J. Baker, Inc., 32 F.3d 1552, 1556 (Fed. Cir. 1994)). Here, based on Plaintiff's submissions, including at Exhibits 1 through 3 (dkt. 57), Plaintiff has established a likelihood of success on the merits. At the very least, the product Plaintiff purchased from Defendant land scape as depicted in those images establishes that the copyright is being used without authorization. It is not accurate to say that 24Defendant's game card images differ from the copyrighted images, nor are the questions presented on the front of the cards meaningfully different. (See 57-3, depicting similar colors on similar cards with nearly identical questions). Defendant does not argue that Plaintiff will not suffer irreparable harm, and the court concludes that Plaintiff is likely to suffer irreparable harm in the absence of preliminary relief. Finally, Defendant requests a modification of the $8,200 asset restraint that is currently in place. The court agrees with Defendant that the amount currently restrained includes funds that Defendant obtained from the sales of other products completely unrelated to this case which were not alleged to be infringing, so a reduction of the restraint is appropriate. The current restraint is modified to reflect that any funds in excess of $2,500 must be released immediately. The motion for a preliminary injunction [35] is granted and Plaintiff must submit a revised proposed order to the court's PO Box by May 30, 2025. Mailed notice.
