MINUTE entry before the Honorable John J. Tharp, Jr: Upon review of the plaintiff's supplemental memorandum 17 in response to the Court's 5/7/2025 order 14, the Court finds joinder of the 24 previously-named defendants improper. The plaintiff acknowledges that 24 defendants included in the Schedule A in this case were originally named as defendants in case no. 1:25-cv-03976. Based on Judge Gottschall's standing order on joinder in these Schedule A cases, the plaintiff asked Judge Gottschall for an order denying the request for joinder if the court decided to adhere to its restrictive view of joinder. The plaintiff then re-filed its case against the 24 defendants dismissed from 25-3976 (and 7 new defendants), stating on the civil cover sheet that this case is an original action and without noting that any of the defendants had originally been named in 25-3976. The "new" case was assigned to this Court, and Plaintiff again seeks joinder. As such, this scenario smacks of forum shopping: filing a claim, anticipating an adverse ruling, and then filing a new suit that presents the same claim before a different judge. To remedy this problem, this Court will limit joinder in this case to a maximum of one of the original 24 defendants and the seven new defendants. If the plaintiff wishes to pursue its claims against the remaining 23 defendants originally named in Judge Gottschall's case, it must file another suit, with a complete civil cover sheet that accurately notes the history of the defendants who were originally named in 25-3976. The plaintiff is directed to amend its complaint to omit those 23 previously-named defendants no later than 8/5/2025. Mailed notice |
