The Court has reduced the amount requested for both the trademark and copyright infringements. The involves defendants who have infringed in widely varied ways. At the least egregious level (in the view of the Court at least) are defendants who appear to have reproduced images of what appears to be a Sony PlayStation game controller. The Court acknowledges that plaintiff has protectible rights in that but is constrained to say that this particular infringement is relatively low-level on the scale of egregiousness. Because of the wide variation among the defendants and the large number remaining (around 60) the Court is highly disinclined to do a defendant-by-defendant assessment and thus has reduced the damage award for all defendants to what the Court considers to be the least common denominator. Enter Final Default Judgment Order. Civil case terminated. Mailed notice.
