July 30, 2025 |
MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's motion for leave to conduct expedited discovery and electronic service 12 is granted in part and denied in part. The Court grants Plaintiff's request for expedited discovery as the Court finds that expedited discovery is warranted to obtain Defendant's contact information. Enter Order Authorizing Expedited Discovery. Plaintiff's request for electronic service of process pursuant to Fed. R. Civ. P. 4(f)(3) is denied without prejudice. Plaintiff seeks authorization to effectuate service of process by email and electronic publication but has not yet shown that it has a reliable email address at which it may reach Defendant. Any renewed motion must include these details. In addition, Plaintiff filed its initial schedule A 2 under seal without filing a motion to seal. Coupled with the fact that Plaintiff has filed an amended schedule A 11 displaying the name of the lone remaining defendant, Plaintiff has not established exceptional circumstances that would provide any basis for sealing the names of associated defendants listed in its original schedule A 2. See Union Oil Co. of Cal. v. Leavell, 220 F.3d 562, 567-68 (7th Cir. 2000) ("Many a litigant would prefer that the subject matter of a case. be kept from the curious (including its business rivals and customers), but the tradition that litigation is open to the public is of very long standing."). Thus, the Clerk of Court is directed, forthwith, to unseal Plaintiff's schedule A 2. The Clerk is therefore also directed to update the docket and case caption, forthwith, to reflect that "autopartcar6" is the lone Defendant in this case. The motion hearing set for 8/7/25 14 is stricken. If no other relief has been sought, Plaintiff is ordered to file a status report by 8/20/25 updating the Court on the progress of expedited discovery and proposed next steps in the case. STATUS Report pursuant to Minute Entry Order 15 by Intersport Corp. d/b/a WHAM-O |
21 |
Aug. 22, 2025 |
MINUTE entry before the Honorable LaShonda A. Hunt: Notwithstanding the Court's prior order expressly finding no grounds to seal documents in this case 15, Plaintiff filed a new sealed document 17 without seeking leave to do so as required under Local Rule 26.2. The sealed motion for electronic service 17 is therefore summarily stricken. The Clerk of Court is also directed to unseal the documents filed at 2, as previously ordered, and 12 17, forthwith. Counsel is admonished that further disregard for court orders and the applicable rules will result in a rule to show cause why sanctions, including dismissal of this case, should not be imposed. If no other relief has been sought, Plaintiff is ordered to file a status report by 9/4/25 updating the Court on proposed next steps in the case. The motion hearing set for 8/28/25 19 is stricken. Mailed notice. |
