MINUTE entry before the Honorable Rebecca R. Pallmeyer: This court is in general willing to enter a TRO and asset restraint to curb unlawful trademark infringement. It is concerned, however, about the vast scope of relief sought in this case, which purports to sweep in suppliers of "automotive maintenance and replacement parts, automotive accessories, key chains, apparel, and home decor products using infringing and counterfeit versions of GM's federally registered trademarks (the 'Counterfeit GM Products')." The complaint does not offer any examples, nor does it offer specifics about the products being sold and the ways those products use or infringe Plaintiff's protected marks. Without more specifics, an overbroad asset freeze appears to be at least possible, if not likely. The court invites a supplemental submission to address this concern. Mailed notice. |
