Dec. 5, 2025

MINUTE entry before the Honorable Sunil R. Harjani: Plaintiff represents on the civil cover sheet 2 that "This case is a refiling of case number 25-CV-10453 previously dismissed by Judge Harjani." Upon review of the record in 25-CV-10453, the case was not dismissed by Judge Harjani. In 25-CV-10453, the Plaintiff filed an amended complaint on 10/3/2025 against a single defendant and proceeded to litigate the matter until a final judgment was entered on 12/3/2025. Plaintiff identified incorrect information in the civil cover sheet. As such, this case has been improperly assigned to Judge Harjani under Local Rule 40.3(b)(2) because it is not a refiling of a dismissed case. The Clerk is directed to reassign this case pursuant to Local Rule 40.2(a). Plaintiff is cautioned to ensure this does not happen again in future cases. Mailed notice

Dec. 8, 2025

EXECUTIVE COMMITTEE ORDER: Pursuant to the entry by the Hon. Sunil R. Harjani on December 5, 2025, the cases listed below were identified as improperly assigned to him, under Local Rule 40.3(b)(2); therefore IT IS HEREBY ORDERED THAT the Clerk of Court shall reassign the cases listed below, pursuant to Local Rule 40.2(a), in accordance with procedures approved by the Court. Case reassigned to the Honorable April M. Perry for all further proceedings. Honorable Sunil R. Harjani no longer assigned to the case. Signed by Executive Committee on 12/08/2025.

Dec. 10, 2025

MINUTE entry before the Honorable April M. Perry: Plaintiff's motions to seal 8 and to exceed the page limitation 11 are granted. Plaintiff's ex parte motion for entry of a temporary restraining order 12, including a temporary injunction, a temporary asset restraint, expedited discovery, and electronic service is also granted. Plaintiff's written submissions establish that if defendant was informed of this proceeding before a TRO could issue, assets would likely be redirected, defeating Plaintiff's interests in identifying defendant, stopping the infringement, and obtaining an accounting. The Court finds that (1) the submitted evidence establishes a likelihood of success on the merits (including evidence of active infringement and sales into Illinois); (2) the harm to Plaintiff is irreparable and cannot be fully compensated by money damages; (3) an injunction is in the public interest because of the consumer confusion caused by counterfeit goods and infringement interferes with Plaintiff's ability to control its intellectual property; and (4) there is no countervailing harm to defendant from an order directing it to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it is an effective way to communicate with an online marketplace defendant. Expedited discovery is warranted to identify defendant and implement the asset freeze. If Defendant were to appear and object, the Court will revisit the asset freeze. A $1,000 bond is sufficient to secure the injunctive relief. Given that the TRO will expire on 12/24/2025, Plaintiff is instructed to not wait until the last minute if it plans to seek an extension of the TRO. Finally, Plaintiff is directed to the Court's standing order on its website directing the filing of the Court's Schedule A Template within 14 days. Enter order. Mailed notice. (jcc,)
