Upon review of the record in 25-CV-10453, the case was not dismissed by Judge Harjani. In 25-CV-10453, the Plaintiff filed an amended complaint on 10/3/2025 against a single defendant and proceeded to litigate the matter until a final judgment was entered on 12/3/2025. Plaintiff's motion for an ex parte temporary restraining order 15 is denied without prejudice. In order to be entitled to equitable relief like a TRO, the Plaintiff must show (among other things) that there is ongoing or impending harm. Swanigan v. City of Chicago, 881 F.3d 577, 583 n. 2 (7th Cir. 2018). "Past injury alone is insufficient." Simic v. City of Chicago, 851 F.3d 734, 738 (7th Cir. 2017). Plaintiff's exhibits in support of its argument of ongoing harm in this case are from December 2024, January 2025, and February 2025. This is not sufficient evidence of ongoing harm. Should Plaintiff re-file for a TRO, it is encouraged to submit live weblinks along with recent screenshots of the alleged infringement in support of its argument that it is subject to ongoing harm.
