MINUTE entry before the Honorable John J. Tharp, Jr: In view of the plaintiff's notice of voluntary dismissal pursuant to FRCP 41(a)(1)(A)(i) [14], this matter is concluded. However, the Court observes that the notice purports to dismiss all defendants without prejudice, even though the plaintiff voluntarily dismissed the same claims against most of the same defendants in at least two other cases. See 26-cv-04632; 26-cv-04705. As to the defendants who have been voluntarily dismissed from a previous case, only the first dismissal under FRCP 41(a)(1)(A)(i) is without prejudice; the second is with prejudice and constitutes an adjudication on the merits. FRCP 41(a)(1)(B). As such, the present dismissal is with prejudice for all defendants that have been named and voluntarily dismissed from the prior actions listed above. Civil case terminated.
