Jenkins: It does not appear that there was a sufficient basis for the court to order e-mail service upon the defendant in this case under the Seventh Circuit's decision in Kangol LLC v. Hangzhou Chuanyue Silk Import & Export Co., No. 25-2205, 2026 WL 1502198 (7th Cir. May 29, 2026). In particular, it does not appear that the named defendant's physical addresses is not known (see Hague Conv., art. 1). Instead, the complaint alleged only that "online marketplace platforms like those used by Defendant do not adequately subject new sellers to verification and confirmation of their identities, allowing infringers to routinely use false or inaccurate names and addresses when registering with these ecommerce platforms." [Dkt. 14, para. 17.] This statement would suggest only that Defendant posted physical addresses that are generally or commonly fabricated, which to the court does not appear to be the same thing. Kangol holds that the Hague Convention prohibits email service to an entity in China. Plaintiff is asked to submit a supplemental brief on service in light of Kangol by June 15, 2026.
