MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for leave to file under seal [3] is granted. Plaintiff has sued 68 defendants for violations of the Lanham Act and the Copyright Act. It has filed a motion for a temporary restraining order and expedited discovery and, separately, a motion seeking for leave to permit notice of a preliminary injunction hearing electronically. Plaintiff's motions and proposed order say nothing about service of summons. But it is unlikely that plaintiff is intending to serve the defendants with summons in the traditional way (i.e. personally) and that it intends to proposed to serve them electronically. But in the post-Kangol world it would appear that the propriety of electronic/e-mail service under the Hague Convention will have to be litigated on a defendant-by-defendant basis. This, in turn, impacts the Court's view regarding the practical limits of proper joinder. Plaintiff is ordered to show cause in writing by 6/22/2026 why the complaint in its current form should not be dismissed for improper joinder, without prejudice to amendment dropping all but, say, 10 or fewer defendants. An in-person hearing on the show cause order and plaintiff's pending motions is set for 6/26/2026 at 9:15 AM in Courtroom 2103. No telephonic or other remote appearances will be allowed.
