MOTION by Plaintiff Fendi S.R.L. to seal Schedule A and Exhibit 2 to the Declaration of Nicolas Lambert

18

July 16, 2026

MOTION by Plaintiff Fendi S.R.L.for electronic service of process.

19

July 17, 2026

MINUTE entry before the Honorable Martha M. Pacold: Plaintiff's motion [14] to proceed under seal is denied. Proceeding under seal is extraordinary. Plaintiff has not identified circumstances warranting such extraordinary relief. See generally Eicher Motors Ltd. v. P'ships & Unincorporated Ass'ns Identified on Schedule "A", No. 25-CV-02937, 2025 WL 2299593 (N.D. Ill. Aug. 8, 2025). Plaintiff's motion [18] for electronic service of process is denied. In support of its motion, plaintiff seems to indicate that it ascertained a potential address for defendants but vaguely suggests that it could not verify the address. The court does not, then, have the degree of confidence necessary to permit service via email. See Mullane v. Cent. Hanover Bank & Tr. Co., 339 U.S 306, 319 (1950); Kangol LLC v. Hangzhou Chuanyue Silk Imp. & Exp. Co., 177 F.4th 793, 799 (7th Cir. 2026). Plaintiff, therefore, shall attempt physical service, and if that proves unsuccessful, plaintiff may renew its motion for electronic service. Plaintiff shall file a status report on the progress of service by 9/4/2026. Mailed notice.

Aug. 28, 2026

MOTION by Plaintiff Fendi S.R.L.for electronic service of process.

26

Sept. 2, 2026

MINUTE entry before the Honorable Martha M. Pacold: Plaintiff's motion [24] for electronic service of process is granted. While a preferable means of service, the court is cognizant of the fact that physical service is not always possible. In this case, Plaintiff certifies that it has attempted, but has been unable, to obtain a physical address for defendants. In such a circumstance, a less preferable form of service is permissible. Service via email is "reasonably calculated" to be received by defendants, and it is thus adequate in this case. Mullane v. Cent. Hanover Bank & Tr. Co., 339 U.S 306, 319 (1950). What's more, service via email is not barred under Fed. R. Civ. P. 4. Thus, plaintiff may serve process via email. Plaintiff's memorandum [23] establishes that joinder is proper. In light of the 8/28/26 status report [25], the 9/10/26 status report deadline [22] is stricken. Instead, plaintiff should file an updated status report by 10/14/2026. Mailed notice.

27

Sept. 2, 2026

MOTION by Plaintiff Fendi S.R.L.for order directing clerk to issue summons.

28

Sept. 8, 2026

MINUTE entry before the Honorable Martha M. Pacold: Plaintiff's motion for order [27] is granted. The Clerk of the Court is directed to issue a single original summons in the name of "The Partnerships and Unincorporated Associations identified on Schedule A of the Complaint." Mailed notice.
